Hotels have a duty of care present in favor of their customers. The law provides that the hotles

Receiving guests’: one of the most significant 'public duty' of any hotel is the duty to receiving
guests. However it needs to be noted that this duty is not absolute, and therefore it is subject to
lawful excuses. Generally, the hotels may deny accommodation to a prospective guest on
account of several reasons, for example, if the person is not willing to pay for the room. Or is
this really under the influence of alcohol or some other drug or is creating a nuisance.

Generally the hotel's reserve the right to evict a guest and retain the room rental payment even
after the eviction of the guest due to several reasons like nonpayment, disorderly conduct, using
the hotel premises for unlawful purpose or using false pretenses and for getting the
accommodation. Therefore, generally speaking, in order to escape liability for evicting a guest,
it is required that either the guest should have refused to pay or it should reasonably believed by

The laws and regulations related with industrial relations in Australia are prescribed by the Fair
