Public Opinion and US Supreme Court: The Influence of Decisions

This report provides an analysis of the relationship between public opinion and the US Supreme Court, exploring how public perception influences judicial decisions. It examines the Court's role in the political system, including its authority in interpreting federal law and its reliance on other branches of government. The report highlights landmark cases, such as those related to wiretapping, the Affordable Care Act, and gay marriage, demonstrating the impact of the Court's decisions on society. According to the analysis, the public opinion which pertains to the US Supreme Court is
important because of the unique position of the court in the political system. The three aspects
involved are how SC possess a major authority in the Australian government with the ability to
render the statutory interpretations over the federal law and the status. The aspects of the judicial
supremacy and the Court uses SC as a tool for judicial review as a means. Secondly, the Court
does not tend to possess any formal mechanism which is for enforcing the rulings and the reliant
on the other branches, lower courts and the states (Wihbey, 2013). Thirdly, in a democracy,
judicial independency and the accountability are in conflict.
Some of the examples are:
a. The Supreme Court has been upheld with the legality of the wiretapping in 1928 case of
Olmstead v US Justice Louis Brandel.
b. In 2012, the ruling for the landmark on Affordable Care Act was handed. Here, the
scholars needed that SC was standing with public.
c. In 2013, the decision for the gay marriage, the Voting Rights Act also included the
perception of public.
The decisions having major impact on society were:
a. The gay marriage where the people were able to openly show their affected to the same
sex people.
b. Dred Scott v. Sandford, 1857 about handling the black slaves and landmark decisions
deemed the government to regulate slavery (Criminal Justice, 2016).
c. United States v Nixon 1974 is about the ruling where he was forced about investigating
the crime with damaging evidence about the men indicted.
