INTRODUCTION
Business law is defined as one of the most important law which explains about the
importance of following the law within the business entity. It is necessary that any of the
business must follow all of the legal rules and regulations for accomplishing the goals within the
given time period. In context of the file, there will be discussion about the statue law and how it
is applied within criminal and civil cases.
MAIN BODY
Write an essay to show an understanding of how statute and case law are applied in both criminal
and civil cases and clearly explain how the court system operates in the UK
Statutes are explained as the written enactment of a legislative body which govern all of
legal cases within the society, community, state or the nation. It is mandatory that any of the law
which has been passed must be followed as per the guidelines mentioned in it. In any of the
circumstances any of the people is not allowed to breach and of the terms and condition and if it
will happen then legal charges can be imposed (Miller, R. L., 2016). On the other side, the law of
UK has granted the power to court to form the law as common law or cases. Whenever they form
any of the law to solve any of the case, it becomes mandatory to be followed by everyone in any
of the circumstances. Case laws are also effective because it makes easy to sort any of the case in
best possible manner through which people not required to face any of the problem. Talking
about both, statutes a common law, they can effectively solve the case related to civil and
criminal litigations.
Criminal Case are those form of cases where people committee the mistake which creates
issues for the society. It is essential to understand that whenever any of the criminal litigations is
charged against the person they there is the required of statutes to solved the issues by giving
appropriate judgement against the defaulter (Basedow, 2017). On the other side, when it comes
to civil cases, this are those cases where people are charges with certain amount of penalty for
realizing the people or the organization to resolve the issues or making them understand that the
work which has been performed by them is illegal. Here, very minimum chances are available
that people get the punishment of imprisonment because this types of mistakes do not create
issues for the public at large.

As there are number of cases on a regular basis which can be seen where criminal and
civil litigations are charged against the person. It is necessary to understand that all of this cases
can be easily resolved with the help of statues and case law (Allen and et. al., 2016). Firstly,
statues law has the written legislations where judges are required to overview the situation of the
case to resolve the problem. If in case, the criminal charges have been imposed, proper facts are
required to be presented in front of the jury for the purpose of declaring the result. Here,
judgement is declared on the basis of presented facts. It is one of the less time consuming process
through which issues can be resolved and appropriate punishment can be given to the defaulter.
When it comes to declaring the judgment with the help of case law, it is quite complex process
because detail analysis is required to be obtained for resolving the case. Here, criminal and civil
case can be solved by having the analysis on past cases which are of similar nature. It can easily
allow to resolve the case. Also, judges get the opportunity to pass the new law under case law
and declare the appropriate judgement on the case so that problem can be resolved easily within
the specific time period. In short, both statutes and common law can easily allow to resolve the
cases where suitable judgement can be given as per the requirement of a case (Snyder and
Maslow, 2018).
While talking about the operation process of UK court, it is said that there is different
requirement which is to be fulfilled. Firstly, case is required to be filed by the authority of police.
The second most important things which is considered by court is the facts which has been
presented by the party. In any of the situation, the UK court system is not allowed to entertain
any of the case if there is no availability of facts in the case with prior filing the charges for
mistake, whether it is criminal or civil. While talking about civil cases, these are mainly
considered or heard with the high court for declaring the result. On the other side, there is the
criminal cases which are required to be entertained within the cases Magistrate or Crown Court
(Peterson and et. al., 2016). But, there is the huge role which is required to be played by lawyers
where they are needed to present the facts so the decision can be given within the short time
period. Also, the judgment which are being passed by the court must be followed as per the
orders given by the jury.
