services. Further, there are many rules and
regulations which has been framed by
government which has been discussed along
with their strength and weakness.
There are many legislation policies which has been framed by government to
protect people from abuse. In NHS it is responsibility of higher authority to defend
people who are abusing at workplace. The following are some act which has been
described along with their strength and weakness.
Data protection act 1998 – It is defined in different ways in which information
about living people are legally used. The main intent of this act is to protect individuals
against abuse of information about them. There are some principles of data protection act
1998 which specify that personal data of people must; be accurate and contain reliable
information, should be protected from unauthorised or unlawful processing so accidental
loss can be reduces. The strength of this act is that, data of individual are protected safely
and proper records are maintain by organisation. But weakness is that it become difficult
for individual to take information of other people until and unless they are having
sufficient reason.
Health care standard act 2010 – This form the cornerstone of overall quality
assurance system within NHS. The purpose of this act is to embrace the principles of co-
production and prudent in health care, encourage practices of people which is up to date,
effective and efficiency, to promote accountability of health service to uses in order to
serve high quality of services. The strength of this act is that it provides support to all
people whether who are below the age of 16 and serve quality of services. But weakness
is that it become difficult for user to provide equal treatment to all people at same level
of stage.
Mental capacity act 2005 – Mental capacity Act is designed to protect and
empower individuals who is suffering from lack of mental capacity to make their own
decision for better treatment. This law applies to individuals whose age is above 16.
Some example of people who are suffering from lack capacity are; dementia, brain
injury, severing learning disability or stroke. The strength of act is that every individual
is having right of to take own decisions which should have capacity also to prove
themselves as right. But weakness is that, this act is not applied to those people who are
below the age of 16.
