performance of staff that are direct reports.
For you to be assessed as competent, you must successfully complete two assessment tasks:
Assessment Task 1: Knowledge questions – You must answer all questions correctly.

Information for students
Knowledge questions are designed to help you demonstrate the knowledge which you have
acquired during the learning phase of this unit. Ensure that you:

Provide answers to all of the questions below:
1. Explain the key provisions of the Fair Work Act 2009.
The key provisions of the Fair Work Act, 2009 are as follows.
Providing a balanced framework for cooperation in the business workplace
Providing workplace relation law which are fair to every Australian workers regardless
of race and background
Ensuring a safety net in the form of minimum, fair and relevant national employment
standards
Making sure that most of their work that employees do result in a balanced work
environment where they find enough time for their families
2. Explain the key provisions of each of the following Acts:
a. The Racial Discrimination Act 1975 – The major provision of this act is to ensure that
nobody is discriminated against on the basis of their colour of skin, race, ethnicity and
origin and to ensure that the workplaces are free of derogatory bias
b. Sex Discrimination Act 1984 – The major provisions of this act are built around to make
a framework which protects people from discrimination on the basis of their sexual
identity, orientation, gender and whether or not they are pregnant and if they are, it also
has provisions to prevent discrimination on breastfeeding
c. Disability Discrimination Act 1992 – The major provisions of this act are built around
protecting disabled people from discrimination which they get subjected to in different
parts of their life including public areas and private workplaces.
3. Explain the purpose of the National Employment Standards and the 10 minimum entitlements.
The national employment standards are one of the major provisions listed in the Fair Work
Act, 2009 and its main purpose is to build a safety net around national system employees of
Australia by granting them minimum standards of employment and job related schemes. The
10 minimum entitlements are as follows.
Maximum weekly working hours which for a regular employee is 38 hours

4. Explain the use of modern awards in workplaces.
Modern awards in the context of Australian workplace are legal documents which contain
minimum pay rates and general conditions of employment and vary from one industry to
another which makes them upwards of 100 in number. It is used in the workplace to assure
employees and cover and inform them regarding their minimum terms of employment and
their benefits on top of the national employment standards. They are important to ensure
employee rights and are used to provide employees with necessary cover at their places of
work.
5. Identify at least two examples of modern awards using the Fair Work Ombudsman website.
Write down the name of the award and the minimum wages under the award and minimum
working hours.
Modern awards are concerned with covering employees in terms of their minimum pay rates
and entitlements on top of what national employment standards state. Two examples have
been listed herein taken from the fair work ombudsman website.
