Q1) What type of custody arrangement do Thida and Kevin have?
There are several different types of child custody granted in times of separation and
divorce. The different custody types include; physical custody, legal custody, sole custody, joint
legal custody, and joint physical custody. In the case of Thida and Kevin, the custody type is
Joint physical custody because both parents have custody over the children in specific times of
the year. Kevin has time over the summer to stay with the children although his time is limited.
Thida stays with the children for most of the time. Joint custody demands that the more able
parent contributes to the child more than the less able parent (Standley and Davies, 2013). In this
case, Kevin has a high paying job as a successful lawyer while Thida is a part time teacher but
are equally successful in their investments and inheritance received.
Q2)What rights/obligations does this type of custody arrangement
give Thida and Kevin?
In family law, custody seeks to find the best interest for the children.
The court has given primary custodial duties to Thida since she lives with
them. She has full custody and makes decision that are day to day affecting
the children As for Kevin
He has the right to be involved in the major decision affecting the
children eg school.,

He must track child support payments, he must stick to the visitation
schedule as agreed, and he must be informed before Thida makes major
custodial decisions.

Q4)Kevin is arguing that he should pay less child support because a) he pays the children’s
air costs when they visit him and b) he has to support his twins. Assess the merits of these
arguments.

Kevin has no merit to this argument. The air cost to his children are obligatory as they
have joint legal custody. He must see his children so he has to provide means by which they are
going to visit him. Secondly, if he supports the twins is good, however, his partner, France earns
$ 600,000 which is four times his annual salary. His income is not strained at all considering
factors like they have more to support the twins. Kevin should pay for the child support and not a
dime less (Gaffney-Rhys and Barton, 2011).
Birth of the obligation to give food
Regarding the birth of the obligation, although establishes that the obligation to provide food is
required from the moment they are needed, these will not be paid until the date on which the
corresponding demand is filed .
Since it is one of the chapters that leads to more legal disputes, due to the non-
compliance or delay in the payment of alimony, all the data inherent to its fulfillment must be
detailed as accurately as possible, such as the periodicity, the place, the form of payment, the
number of annual payments, the revaluation of alimony, etc (Gaffney-Rhys and Barton, 2011).
Expenses for the education of children
These expenses are included in this maintenance pension. Education expenses include not
only the compulsory education of minor children but also the studies of training of the
university's older children or not, provided that it is proven that they are taking advantage of their
performance.
