Answer Development of national policy of Australia is being maintained by
Safe Work Australia. They are responsible for improving work health
and safety at workplace and it does not control or impose WHS
legislation. It is a business owner’s responsibility to satisfy all the
requirements of WHS which has been set out to carry out any
business in a state or territory.

Question 2 Explain how state/territory legislation impacts the rights and responsibilities of persons
conducting a business or undertaking (PCBUs), officers and workers, including a duty of
care.
Answer According to Safe Work Australia an employer has to provide and
maintain safe system of work, storage, structure, sufficient facilities
to the workers and safe use of the instruments at work in conducting
a business or undertaking.

Answer The WHS has described specific duties for a corporation and

Answer The 2004 Act is about the duties of employees. Employees are
responsible for their own health and safety. They should take
reasonable care of other’s health and safety and must collaborate
with the employer for any clarification regarding the requirements of
OHS.

Answer According to Leave Act 1976 if an employee has been working for a
single employer form last seven years, he will be eligible for taking
long service leave. According to the Children and Young People Act

children and young people whose family members are working with
them.

Question 7 How does state/territory legislation affect performing hazardous manual tasks in a
community services environment? Provide two characteristics of a hazardous manual task.
Answer State legislation has a general duty of protecting health and safety of
workers at the workplace. It covers organisational factors of
psychological and physical health like extreme work load can
increase the probability of injuries. According to state legislation all
organisation must follow hazardous manual task to minimise these
factors.
