effective talent so that firm can increase their productivity and profitability.
There are heterogeneous functions of Human Resource officer which is to perform, scrutinise the
critical issues faced by the Chocolate Presence organization and rectifying them in timely
manner without any delay.
Chocolate Presence is an organization known for its expertise in tailor made chocolate-based
greeting cards. As there is high unemployment in the area in which the company is located. It is a
great opportunity for this company to recruit the appropriate candidate and fulfil the deviation of
the “QUALITY ISSUE” which the Chocolate Presence organization is facing and also the poor
recruitment process in which the organization is failing to conduct professional interview and the
test and also giving priority to the references.
As a Human Resource officer, Sit is essential to MANAGE the Chocolate Presence
organization's employees and provide support to HRM by taking appropriate action towards the
deteriorating factors of Chocolate Presence organization.
In Chocolate Presence organization there is a need to improve the recruitment process by
recruiting the talent by conducting professional interview which is not just an informal round of
15 minutes rather a serious discussion must be there which scrutinise the people who can really
devote to the Chocolate Presence at there best. As a Human Resource Offers the purpose is to
follow the process of the recruitment to get the best possible result. Such process is mentioned

RECRUITING PROCESS:
Document Page
Planning:
Planning is much needed in the organization because it will decide the comprehensive job
specification. The relevant responsibilities, education, skill required, experience required and all
the terms and condition of the job. Here the appropriate candidate should be selected based on
the above mentioned requirement and the role and responsibilities of him or her should be clear.
Medium:
There are many media via which the Chocolate Presence can do recruitment like adverting on
newspaper, Facebook, Instagram and several other platforms. Here there is a plenty of
unemployment which can be fulfil via these medium. People will become more aware of it and
there will be more applications as well as more competition, and it will ultimately help the
Chocolate Presence in selecting the best out of the best.
Short listing:
Short listing the candidate or screening of the candidate after getting applications involves great
time and effort, here the Chocolate Presence is expanding at a rapid pace and is in need of the
new and innovative talent which give a further glow to the organization, and helps in expansion
of the organization as per the trend. For example, there are so many applications for the
university but it selects the best candidate so the name of university or reputation of the
university cannot be questioned. In Chocolate Presence organization they are also facing the
quality issues, so short listing the appropriate candidate for that role is very important.
Reward management:
Salary or wages is also an important factor which a HR officer of Chocolate Presence should
consider at the time of selection so that it avoids any chaos between the employee shortlisted and
the employer. The employer should decide to which department it is required to pay more or less
and also pay according to work experience. Here in the Chocolate Presence Organization
Chocolate production team should be paid more to hire the most excellent talent. Reward
management can be in cash or in kind. Rewarding the employee for the good work done by them
in form of gifts annually, giving holidays or giving discounts on tickets to travel, they are some
the example of rewards in kind.

an HR officer is also to manage the performance by evaluating the performance done by the
employee in timely manner and conducting meeting regarding strength and weaknesses of the
employees. If the employee is working not at the desired pace then telling them about the poor
performance and the ways to improve it, it is to be done not in the public and appreciating the
employee for the good work done openly to boosts the morale of the employee and this will also
encourage the employee to work more effectively.
b. Explain the strengths and weaknesses of different approaches of recruitment and selection.
Recruitment and selection
Company is making use of homemade assessment test (promotions) which is a time
saving process as chocolate company already know the work ethic and approach of the
employees already working with them. It is money saving process because less paper work and
they do not have to issue new keys passwords etc. It can allow introduction of new innovative
ideas to the chocolate company. The new hired candidates may have less political issues in the
firm chocolate presence organisation.
Company is also making use of informal chat as the method of recruitment and selection.
It provides higher number of choices for selection to the chocolate company (Bailey and et.al.,
2018). In this hiring new candidate can bring new excited innovative ideas to the company.
Informal chat can measure confidence level, communications skills, and presentation of the
applicant. Informal chats determine the detailed information in depth as well as personal
thoughts and opinions of the applicant. It can create discord in between the other employees and
can be harmful for the environment of the company. It provides limited choices for selection to
the chocolate company. It is a time consuming as well as money consuming process – hiring new
candidates. It can be time and money consuming process as they need to hire an talented HR who

are involve in informal chat. It’s difficult to determine the honesty and integrity of the applicant
during informal chat.

c) The key elements of employment legislation and the impact it has upon HRM decision-
making.
Each state is having its own separate laws and these laws sometimes beneficial for small
organizations because of the small size of them and so as the operation. So the HR must be
sound enough towards the related laws or applicable laws and must be updated always to
prevent the Microsoft from any liability.
Microsoft as a giant software company must be prominent in following of all the applicable laws
to ovoid any penalties. Agile employees are employed in the Microsoft company and so the
operation should also be agile of the Microsoft. There are several legislations which a HR must
follow and are stated as follows:
Discrimination Act 1995:
Discrimination Act 1995 stops abusing against employees on the basis of colour, religion,
sex. This regulation is applicable on Microsoft because Microsoft has had 20 or more employees
on the payroll. On the basis of the above mentioned reasons the employer can not discriminate
Document Page
the employees and can not refuse to hire them. Hence, the HR decision-making will prevent the
employees from such nuance.
The Fair Labour Standards Act (FLSA)1938:
The Fair Labour Standards Act (FLSA) determined the amount for the minimum wage
which is periodically revised and it also applicable to Microsoft. HR professional should be
updated continuously for any change in the minimum wage rate. HR professional should also
verify that whether the accuracy of the wage paid to the employees on continuous basis to
prevent Microsoft from any penalty which is very high. FLSA also applies to the employees
working overtime that is more than 40 hours a week. Microsoft must be very careful related to
follow this law because it can create disaster to the Microsoft if not followed on regular basis. So
the HR decision will help the employee in getting the overtime wages and it will boost the
employee to work more and get reward for that.
FMLA (The Federal Family and Medical Leave Act) 1993 :
FMLA (The Federal Family and Medical Leave Act) allows taking 12 weeks of unpaid
leaves in a 12-month to the eligible employee, the leaves can be of various reason such as serious
health issue of the employee (spouse, child, new baby born of the employee). Up to 26 weeks of
leave are allowed for the employee who is caring for the eligible employee in the employee's
critical situation. The HR staff should train the manager and relevant person regarding this law in
the Microsoft. The employee of the Microsoft does not even have to mention FMLA to request
for the leave to the employer and the burden related FMLA time appropriation lies on the
employer. Perhaps the HR decision will help the employee in getting appropriate leaves during
there critical situation and also the employee will not be getting fired.
Disability Act 1990:
There are many federal laws for the employee working in the Microsoft having disability.
The Disability Act do not allow the employer to fire the employee on the basis of disability. As
per the Act the employer have to provide reasonable accommodation to such employees with the
disability apart from the accommodation the Act also allows various other facilities for the
employees which the HR of the Microsoft have to comply with on regular basis. There are
several other laws and regulation also related to disability and medical some of them are as
Document Page
follows: Genetic Information and Non-discrimination Act (GINA), The Health Insurance
Portability and Accountability Act (HIPAA) etc. The HR decision related with Disability and
Medical will enhance the positivity and confidence among the disabled employees.
So these are some the laws and regulation which the HR of the Microsoft must follow to create a
positive impact on HRM decision making.
