Introduction
For many years, parliament considered the regulation of immigration consultants. The
process started in 1995 when the 1st Standing Committee report was published, on the
issue. Issues concerning the behavior of immigration consultants were raised especially in
relation to how they affected potential applicants and members of the general public. These
issues were mainly reiterated by the 2003 “”Report of the Advisory Committee on
Regulating Immigrant consultants, (Ministry of Public Works and Government Services
Canada, 2003). As a result, these victims became vulnerable and unprotected from abuse,
fraud as well as misrepresentation by the consultants. In this report, three issues were
raised.
The issue
First, there was a lack of standards from the immigration profession. Before the government
regulated the immigration field, anybody could establish himself or herself as an
immigration consultant, (Bélanger & Candiz, 2019, 10). This was regardless of competencies,
education or any experience. As a result, the quality of consultancy services being provided
varied.
Secondly, there were no structures that could be used to protect different consumers. These
structures include formal or official complaint mechanisms, compensation funds or
