INTRODUCTION
Justice can be defined as a quality of being righteous and moral rightness is the main
principle in law. This study is based on a case of Bradley Wernham who committed around 662
crimes and he was released after 18 months of in prison. This study is going to discuss
principles of justice that need to be considered by courts in order to provide fair judgement.
Fairness, equity and justice are main principles of justice and some principles were used in the
case of Bradley Wernham as he was then sentenced for five years and 6 months. Different types
of punishment will also be discussed in this study in order to identify relevant punishment of this
case.
MAIN BODY
Investigating types and principle of justice
The word justice is known as action related to law that basically means to be impartial,
fair and right. According to jurisprudence it means implementation of religious law and these
rules are related with some societal norms as well as provide member of society with fair
treatment. Thus, in simple words justice allow solving conflicts and to bring sense of stability
among society members (Gurney and et.al., 2021). Along with this, injustice can increase
dissatisfaction among members and it may lead to revolution which will hinder the peace of the
society. Although there are different ways through which justice can be expresses such as
distributive, procedural, retributive and restorative. These types of justice have importance in
socio-economic, civil, criminal justice and political at both international and national level.
Distributive justice: It also known as economic justice that is related with providing all
member of society with fair share of the benefit and resources available. However, it has been
said by many scholars that every human being is entitled to have share in the wealth and it
should be distributed fairly (Cadena, Chaudhri and Scott, 2022). The term fair share is related
with term equity, equality and need. Equity means that one should receive equal reward for
their contribution in society whereas equality means that everyone should have same rights and
justice. In case of distribution on need means one who require more will get more and one who
need less will get less.
Procedural justice:
It deals with making and implementing decisions on the basis of fair process in order to treat
people appropriately. Although justice system rules are made and applied so to get unbiased

decision as well person carrying out the procedure need to be neutral. However, principle of
natural justice play important role in it and give an opportunity of speaking to people that have
been affected decision-making process (Jamal and Higham, 2021). The process of fair justice
include dispute resolution, mediation, adjudication and negotiation.
Retributive justice:
The term just desert means that member of the society are supposed to be treated in the same
way as others. This justice system states that one who will not follow rules properly will have to
face consequence of their actions in form of punishments and penalties. However, it states that
level of punishment should be high so that no other person will involve in any illegal activities
as the risk is too high. The retributive also play important role in international legal proceeding
that are related with violation of international law, war crimes and human rights.
There are three principles of justice:
Equity: This states that any person comes to court need to be treated the same and
there should be no discrimination on the basis of gender, sex, culture and religion. Thus,
it means treating everybody same no matter what the situation.
Fairness: This principle means treating people on the basis of their situation and crime
committed as there are severe penalties. Along with this, everybody should be given an
opportunity to present their case without discrimination and strict rules.
Access: It means that any person can make use of the resources and procedure that has
been given by legal system and it seeks legal remedies in case of any circumstances.
In the case of Bradley Wernham it has been seen that principle of fairness has been used
by the court as it has been given punishment on the basis of crime which has been committed by
it. Along with this, opportunity of speaking during the procedure has also being given and legal
remedies are provided in case of any in justice (SustaAlberts and et.al.,2022). Moreover, it can
be stated that principle of access has also been followed throughout the case as it was provided
with accommodation facilities.
Furthermore, it can be seen in the case that retributive justice system has been used as bardely
has committed various petty and heinous crime against state like breaking into church as
disturbing the peace and tranquillity of society members. This system has been followed in order
to heal the victim and strengthen the community to prevent similar crime.
