INTRODUCTION
Trade description act, 1968, ensured that advertised
products and services are performed at time of
execution. Overall the services advertised should be
accurate as per the description and should be of true
nature.
LEGISLATION
It comes under the responsibility of trader to ensure
description shall not amount to trader. If the same is not
met with the description, then it is would be fair to void
the contract. In consumer protection act, 1987,
consumers are protected against the misconduct.
Exploitation of customers which takes place in the terms
of charging high prices, offer sub standards goods to
customers which fails to meet the criteria of customers.
Legislation provide redress in case of breach of contract.
If tour operators charges for more units than mentioned
in the contract then it would be termed as misconduct.
Legislation protecting visitors
As per the consumer protection act 1987, it is the legal responsibility of
manufacture to provide relevant information regarding products and
services as stipulated by the health and safety laws. This act restricts the
unethical business practices and includes the following:
Restricts supply of goods and services having poor quality.
Helps in define product liability.
Helps in regulate legal authorities.
Restricts illegal price indications.
Protection of consumers form Unfair trading regulations 2008 is another
legislation that helps in protect rights of consumers with help of following
controls:
Applicability of right surcharge.
Authentic charges.
Availability of room charges.
Disclosure of all prices.
Mini bar charges. Package Travel regulations act, 1992,
assure that miscommunication shall be
corrected at the end of service provider at
the time of making basic facilities and
arrangements. It indicates the minimum
requirement for a contract which must be
there in a holiday contract.
CONCLUSION
Legislations makes it mandatory for service providers to reveal significant information at the time of provision of
contract. Under the Unfair trade practices act, 2008, it is ensuring that all customers are protected against any kind of
unfair services offered by services providers. Act ensures that the parties entering into the contract get benefit.
Mainly the Trace description act, 1968, prohibits the false indicators of prices of goods, services and other related
services. It is very essential for officers of trading standards need to inspect the following things:
Incorrect description related with products and services offer by service provider.
Incorrect statement related with the facilities, services and accommodations offered.
As per the package and travel regulations, 1992, a
holiday package is considered where it contains two or
more than two services at a combined price. These type
of packages are considered more customer friendly and
are more easy to purchase as per its requirements. This
package requires customers to pay a one time price for
entire package which is time saving.
