Lesislation and Ethics in the travel and tourism sector
Contract:- It is a legal agreement which is done by two parties for achieving a common purpose
and objectives. Along with this, contract includes all the rights and obligation of both the parties which is
enforced by the law. In context to, travel and tourism sector contact plays an essential as they make agreement
between the two parties i.e., passenger and the travel company.
IMPORTANCE OF CONTRACT:-
Travel company should provide an information regarding its contract to their customers.
Also, it is compulsory for a travel company that to informed their consumer that they establishing a
contract between them.
Along with this, it contains various form of contract which are described as below:-
Unfair terms in Consumer Contract Regulation, 1999:- According to this, act the motive of
government is to protect their customers not because they are not behaving well with suppliers.
Along with this, it can be done because they signed a contact with customers in which terms and
conditions are mentioned. If a tourism company not made come changes on their goods and services
by taking a consent from customers, then it will be considered as an unfair practices.
Sale of Goods Act, 1979:- This act is formulated by the parliament of UK, where the contracting
parties are binned to do transaction related to transfer of goods from the seller to the ultimate
consumers in monetary terms which is known as commodity price. Like, barter system is not
considered for repaying about the services which is provides by tourism companies to their
customers.
Supply of Goods and Services Act, 1982:- The motive of this act is to provide good quality of
product and services to their customers which should be affordable to them. For example, Thomas
cook, provide good accommodation or healthy and safety environment to their customers, then it
will encourage others to visit their company and do experience their services.
The Consumer Rights Act, 2015:- In this act, they protect their customers from any unfair trade
practices as it could affect customers or can affect their buying process . In instance to Thomas
cook, they provide improper information to their customers which directly affects the buying
behaviour of customers.
In context to travel and tourism sector, these act says that the terms and condition of contract which
made between the travel company and consumers. In addition to Thomas Cook Discovery store, that company
should provide necessary information to their consumers about the contacts in which both the parties can
achieves their common goals accordingly.
There are different types of consumers legislations which is framed through the UK government with the aim
of protecting interest or rights of every individuals or consumers that ensure it not should be violated through
travel and tourism company's agents as well as business owners. It also includes in several kinds of act which
are given below:
Package travel holidays act 1992: This act mainly about the various informations that mostly
provided by tour operators before booked a holiday ticket and before holiday starts. This act ensures that tour
operators or holidays companies that they are re3sponsible for the overall performance of holiday contracts
that includes in different kind of services such as hotels, airlines, cruise operators and so on. It also involves in
the low cost amount of money for each individual so that they can easily book their tickets in an effective
manner. This act also provide safety and securities for their customers so that they can enjoy without any issue
in an appropriate way.
This act also offer different program like if an individual suffered an accident from abroad during
the flight than a person can take action against that airlines instantly. It also give customers health insurance in
order to make them happy.
CPUTR 2008: This act stands for consumer protection from unfair trading regulations act 2008. it
protects the interest or rights of the customers from any kind of unfair trading practices which is mostly done
or accomplish by the providers. On the other side, The consumer protection act 1987 that is the act in which
duties and rights of customers or supplier have clearly mentioned. It determined the legal duties of suppliers in
order to offer adequate information with appropriate details of any product which is formed by several safety
laws and health issues in countries. It also helps in prohibits unfair practices of businesses which are following
in different things:
Define the liability of product.
Unfair practices of trade restricted.
Supply poor quality of product is prohibited
In context of Thomas cook retail company limited they follow several kind of activities which is
performed by their management system in order to make suitable plan or though which are covered in few
policy, are given below:
Firstly company has to create strong relationship with several suppliers who provide better services
to their customers.
Secondly company has to develop no changes strategy during the travelling activities in order to
make discipline at workplace in an effective manner. So that customers can easily gain good experience in a
better ways.
