For questions in Part A, you will need to provide answers that directly address

Question 1 Research and explain the roles and responsibilities of the following
agencies
Australian Competition & Consumer Commission
Real Estate Institute of NSW
NSW Fair Trading
Australian Securities and Investments Commission
Tenants NSW
Promoting fair competition in the Australian market is the primary responsibility of Australia
Competition and Consumer Commission. Being an independent statutory authority in the
country, the Commission plays a huge role in enforcing the provisions of the Competition
and Consumer Act, 2010 and other important legislations to promote fair competition in the
market.
Real Estate Institute of NSW also known as REINSW is an independent body which has the
responsibility of encouraging traders in real estate to maintain a visible clarity and promote
competitive advantage in the real estate business. In order to do that REINSW has the
power of implementing new policies and practices to guide the transactions in real estate
trading.
Taking steps to maximize the adherence with the regulatory requirements, both on the part
of consumers and traders in the market place is the primary responsibility of NSW fair
trading. Ensuring minimization of loss to the consumers for failing to comply with the
regulatory requirements is also broadly on the shoulder of NSW fair trading.
Being an independent Government body of Australia, Australian Securities and Investment
Commission (ASIC) plays the role of the Corporate Operator in the country. By regulating
the companies and financial services in the country ASIC provides necessary protection to
the consumers, creditors and investors in the country.
Tenants NSW provides information to the people of Australia in relations to the various rules and
regulations associated with the Residential Tenancies Act in the country. Along with that providing
necessary advices and advocacy is also part of the roles and responsibilities of Tenants NSW.
Question 2 In property management there are a number of different types of tenancies
other than residential. Give an overview of another type of tenancy and
explain the tenancy agreement that would be signed.
Retail, on-site, industrial and commercial are few of the other types of tenancies apart from
residential tenancy.
Holiday premises management agency agreement, retail agreements are top be signed to
use the benefits of these different types of tenancies.

In case of retail on-site tenancy, industrial and commercial tenancy the onwer of the
property and the tenants will enter into an agreement which shall contain all necessary
details in respect of the tenancy agreement such as period of tenancy, the rent to be paid
by the tenants, property damage clause etc.
Question 3 Research the specific legislation that applies to the following types of
tenancies:
Residential Tenancy
Retail Tenancy
Give an overview of the main legislative requirements of each; eg:
disclosure to tenants, rent increase, term of agreement.
Residential Tenancy Act, 2010, Tenants NSW are few of the legislations which are to be
followed in different types of legislations in the country.
Tenants as well as the land lords have to disclosure necessary facts before completing an
agreement.
The terms and conditions of a tenancy agreement shall be governed by the agreement
signed between the tenant and the owner of the property. A tenants needs to disclose all
the facts about the period for whih the he wishes take the property on rent, the expected
usage of the property, and all the relveant details about te tenant. In case of rental
increases the notice of the same has to be given to the tenants by the owner of the
property.

Question 4 1. What are the responsibilities of a property manager to the landlord in
relation to maintaining the condition of the property?
2. What are the responsibilities of the property manager to the tenant,
whilst the tenant is occupying the property?
The condition of the property shall be maintained properly and the property manager has
the following responsibility in this regard:
Taking all precautions while showing the property to the tenants to ensure there is no
damage to the property.
Inclusion of property damage clause in the tenancy agreement to make sure that in case of
any damage to the property due during the course of tenancy the tenant will have to
compensate the owner according to the agrement.
The specific damages for which the tenants will be held liable shall be includede in te
tenancy agreemnt and the property manager must take note of the same.
To provide the tenants properties in accordance with their requirements.
Ensuring that the rentals are within the standards limits and the tenants are not over
charged.
Protection to the tenants against illegal and forceful evacuation.
Proper maintenance of the property during the course of tenancy agreement.
Ensuring that all the rights of the tenants are protected.
Question 5 Your Landlord contacts you to ask for the phone number of his tenant, as
he is going to install new carpet in the lounge room and needs access for
the tradesman to give a quote. He is very insistent that he must get access
asap.

2. What legislative requirements will affect your decision?
The tenant shall be given the information about the installation of new carpet and then
should ask his permission for the same.
Generally a tenant need to be given prior notice in such case however, if there is no
diagreement between the tenant and the landlord then no issue shall arise.
Question 6 Choose one of the Divisions in Part 3: “Rights and obligations of
landlords and tenants” from the Residential Tenancies Act 2010 and
summarise what the Division refers to.
Ensure that you include the responsibilities of both the tenant and
landlord.
Division 7 has been chosen. Division refers to the specific provisions containing in the
Residential Tenancies Act, 2010. The tenants along with certain rights also have certain
obligations which he must fulfill in order to enjoy the rights without any restriction.
The landlord needs to provide the tenants with all amenities and rights as mentioned in the

tenancy agreement. These include;
Providing a clean and clear property.
Water and electricity facilities.
Regular maintenance of the property.
Privacy to the tenants.

Question 7 1. Explain the process and timeframes for terminating a tenant’s
agreement under the following circumstances:
Non payment of rent
End of the fixed term
2. Explain the tenant’s responsibilities when they need to terminate
their lease during the fixed term of the agreement. (if the break lease
clause is included)
The tenants shall be given a reminedr of his dues and shall be asked to leave the property
in case the default in payment of rent contiunes beyond the due date.
A 30 days notice must be given in case of fixed term tenancy.
The tenants will have to pay the folowing in case of break of lease before thf end of the
fixed term:
Rent for the period untill new tenant takes the property on rent.
A percentage of costs incurred on advertising and reletting fees of agents.
Question 8 When must receipts for rent be issued? What specific information must
be present on a rent receipt?
After the receipts of actual rent from the tenant a receipt must be issued to him
acknowledging the receipt of rent. The name of the tenants, the property rental, the address
of the property, the date of receipts of such rent, the amount received all these information
shall be includede.
Question 9 1. At the end of the month the agency will disburse funds to their
landlords. What specific income and expenditure would be noted on that
statement?
Weekly rent, management fees, letting fees, bond, if any, and any other specific charges if
collected shall be included
2. Explain the process you would undertake on a day to day basis to
ensure all of the information is correct on the end of month
statement.
