INTRODUCTION
Duty care is one of the most important aspect in current scenario as well as it is of high
value in the future too. This report covers various aspects that are related to principles of
implementing duty in social, health, or young people and children’s setting. It is very crucial as it
is the moral duty more than only a legal one and an individual must work in accordance with it
so that it can be beneficial for the service taker.
MAIN BODY
1.1. Discussion of having a care duty in work role that is personal
Duty of care is legal obligation that is imposed on individual and it should be adhered to the
standards. Its is duty of every Doctor to give first and foremost priority to its patients and
disclose them all the information and necessary guidelines to the patients. So, that they are
satisfied with the treatment. Doctors are obliged to take proper regarding the safety of patient.
Doctors must be knowledgable and updated with their skills (Ajibade and Adams, 2019). They
should listen and understand the problem of every patients and guide them accordingly. Patients
must be treated with full care and tell them everything about the disease and treat them with
politely and there should be no discrimination related to any other matter. Doctors are required
to maintain the integrity and confidential information about patients and focus on their overall
health. Doctors must consult to their patients before prescribe any medicines and must be
examined their health issue which are related to past or present. Doctors might be responsible
for any issue occurred during the treatment.
1.2. Evaluation and analysis of duty of care contribution in safeguarding or protecting an
individual
Safeguarding the interest of patients by doctors is primary responsibility and they can not take
this lightly and must be aware of rights of patients. Doctors are giving utmost priority to their
patients and treat them fairly irrespective of their caste, religion and gender. Patients puts full
faith in doctors and consider them as a god (Benson and Grieve, 2016). If Doctors play their
responsibility it create trust and respect for doctors and patients without any doubt can go to
doctors. They are main service provider in society and hold dignity in society. If patients are
healthy and satisfied with service of doctor it develop positive environment in society. Doctors

has a big responsibilities towards its society which should be maintain because they carry trust
and faith of whole society.
2.1. Explanation of differences that can arise between a person's right and the duty of care
In duty of care of doctors towards with patients sometimes create conflicts and issue due to
negligence of own duties and responsibilities towards their work. This can be caused when
doctors did not give attention to the rights of patients (Buetow, 2016). Many reasons could be
there for this conflict such as treat them with improperly, not give attention on their problems,
misguided them, discrimination, lack of trust and faith, lack of understanding between each
other, lack of knowledge and skills and many more. Patients on other hand has a role in this
conflict that is they do not disclose all the information with their Doctors and not give
importance to the guidelines and suggestions given by Doctors and sometimes trust issues
might be the reason.
1.2. Evaluating the effects that discrimination possess
There are various side effects of discrimination that are very harmful for an industry as it can
hamper the growth, profitability, and development. Discrimination can be of different types
depending on the situation like it can be on the basis of caste, colour, sex, religion, gender,etc.
There are many negative effects of it like it can give rise to ill and negative feeling that can
become very stronger as the time passes. Also it can lead to development of jealousy and thus it
can impact the overall working and thus difference prevail within the society due to this.
Further it can cause internal barriers within a nation and it can also result in protest and strikes
by various persons and thus impacting and affecting the whole country and the world (Chico,
2018).
2.2. Evaluation of management of risks that are generated due to differences between personal
rights and the duty of care
There is a great chance of conflicts due to differences between individual right and the duty of
care but there must be a balance between both of them so that both can prevail in the industry
without becoming a barrier for other. As each and every one plans to minimise their risk
whether an individual or a person of duty for care (Cox, 2016). Risks can be of different types
depending on various aspects like current situation, severity of the situation, etc. and hence

decisions are taken accordingly. So personnel that is assigned duty of care should focus more
on giving excellent services and must not hinder any right of an individual and thus by this it
can strike a balance between both the aspects and thus resulting in overall growth, profitability,
and benefits.
2.1. Discussing the codes and legislation of practices that are related to diversity, equality, and
discrimination that apply to own work model
There are various code of conduct and practices of legislations established that are related to
equality, diversity, and discrimination that applies on the model of own work and thus it is
beneficial for each and every individual (Holly, 2018). There are different acts that are made on
the basis of above things and helps all of them are very effective and efficient too in different
aspects like care act of 2014, health and social care act of 2012, equality act of 2010, mental
capacity act of 2005, human rights act of 1998, etc. All these comprise of essential elements
that are very helpful in achieving the desired targets, goals, and objectives that are laid down in
the starting. Thus above all has to be applied according to the need, requirement, and demand of
own work model.
2.3. Identification and analysis of the area from additional support and advice can be used in
situation of conflicts and differences
There are various areas from which additional support and advice can be taken in a situation of
conflicts and differences between both the parties (Sipilä, 2019). The areas that can prove
beneficial in this regard are mangers and support teams that are specialised in handling such
problems, guides, books, journals, self assessment techniques, social media sites, etc. All the
above are possess an important value in support and advice and thus all are very critical in this
aspect. Also various efforts must be put on reducing the conflicts and problems in both the areas
so that instead of rectifications later or seeking advice from other sources problem itself can be
minimised.
3.1. Evaluation of methods of responding to complaints
There are various methods of responding to complaints and different teams of skilled
employees are made so that research and analysis can be done and after that the best one can be
chosen from various other alternatives (Wakeman and Langham Jr, 2018). Mostly used

methods of responding to various complaints are listening patiently about the complain and
after that necessary department must be contacted on which complaint is based on and after that
listening to the reason of fault, apology must be taken on behalf of the faulty team,
rectifications must be done in accordance with the complaint, and after that assuring the
customer that it would not be repeated in the future. These are some basis of responding to a
complaint no matter about the context of the complaint.
3.2. Analysis of points of procedure that is already agreed for handling complaints
There are various aspects that are already decided about handling complaints and a set of
policies and procedures are laid down so that all the complaints are very well listened and
solved out as soon as possible (Hindi, Jacobs and Schafheutle, 2019). There are different points
of agreed procedures for handling complaints such as treating all the complaints positively and
seriously, making the process easier and sorted out for the customers to file complaints. Also a
team that is skilled in this department should be employed so that the complaints take less time.
Apart from this the customer must be provided information about the steps that are involved in
solving the complaint as well as tracking of compliant must also be done so that transparency
can be achieved on every step.
CONCLUSION
Duty care is one of the most important job that one can get due to the responsibilities that
it possess. From the above it can be concluded that there are various ways by which principles
can be implemented for duty in health, social, or child care. Various other measures must also be
taken so that the all the processes can be done quickly, effectively, and efficiently without any
delay and conflicts. Apart from this there are other different acts that can be used as a friend,
philosopher, and guide in adverse situations.
