Fitness for duty: compliance
Note: You’ll need to refer to your position description and the Australian General Freight Co. CoR policy document to
complete these tasks.
Scenario:
It’s a busy Thursday afternoon when you get a call from the receiving manager asking you to come to the office. A
delivery has just arrived and the unloading staff have advised him that the driver appears disoriented. The receiving
manager spoke to the driver and says he is clearly unwell, and wants your opinion as to the state the driver is in.
The load was delivered on time and unloading commenced as per the receiving schedule.
The receiving manager had the safety officer called to escort the driver across the site to the sick bay.
The driver is evasive when you question him about his schedule prior to this delivery, i.e. over the last 24 hours.
The driver tells you he wants to leave as soon as the truck is unloaded, because he has a back load to pick up. Unloading
is expected to be completed in a half an hour.
You check the driver’s paperwork. The delivery schedule is correct but you know by the state of the driver and his
evasiveness, that something is not right. You know the driver is badly fatigued, and you believe he is probably not fit to
drive.
1. What is the possible non-compliance in this scenario?
It is necessary to understand that any of the non-compliance can create huge issue for the person
because lots of legal penalties can be imposed in that respective circumstances. There are different possible
non-compliance which can be seen if further permission can be given. It is said that Duty of care can be
breached and secondly there is high possibility that due diligence will not be followed in this respective case.
Due diligence simply explains that in any of the situation those action must be taken so that person can simply
avoid committing any sort of tort or offence.
2. What are your responsibilities under CoR?
Under Chain Responsibility Policies there are number of responsibilities which must be performed so
that chances of errors can be reduced and effective result can be achieved. Looking at the given scenario, the
most important duty is to ensure that condition of driver must reported to the higher authorities. Must be able
to report council about the possible problem which can be faced if driver continues to driver even after not
obtaining the permission from the authorities.
3. What actions do you need to take in responding to this situation?

After analysing the whole situation of the driver, it can be easily said that driver is not is the state where
he can driver vehicle as per the requirement of law. It is necessary to understand in this respective scenario
driver seems to be unwell which means that there is high possibility of accident so that proper health check-up
should be done so that manger and other authorised person can get the information that whether driver should
be given opportunity or not to driver vehicle. His licence and other documents can be checks which will help to
identify about the position of his last 24 hours which is very much important. Checking of all this documents will
certainly allow to attain obtain effective result that whether permission to drive should be given or not.
4. As part of your supervisory responsibility, you inspect the driver’s work diary (on the next page). For the purpose
of the simulation, imagine he has written in Thursday’s date in the date field.
What do you think of this diary entry? In your answer, explain what you are going to do after seeing this.
The diary entry will be the most important in this respective case because it is the only way through
which entity can accomplish their goals and target. It is necessary to understand that the diary entry will allow to
ensure that whether driver had taken rest or not in last 24 to 48 hours. It is necessary to review daily dairy entry
because it will certainly provide them the way to decide whether permission should be granted to driver or not.
In addition, it will certainly allow to ensure that safety of product which is to be delivered and the life of random
people and driver as well who may directly or indirectly come in contact with truck driver.
