1.0 Introduction
Pitshop Pty Ltd is a privately owned company and has currently owned the
Independent Service Station (ISS) chain of nine stores. Products of the Company
include fuel, gas, oil, hot pies, supermarket goods and cold drinks. The organization
has 60 employees across it stores, who come from varied cultural, linguistic and
educational backgrounds. The office for the organization is attached to its flagship
store and all stores operate on computerized point-of-sale terminals. The owner
feels that with takeover, the organization has undergone tremendous
transformation, hence is in need for WHSMS policy that is distinct from past policy.
The scope of current analysis deals with WHSMS procedure along with WHS policy
that needs to be revised.
2.0 WHSMS core elements
The organization deals with several types of materials which are hazardous in
nature. With employees conducting various operations need to abide by WHS
policies to prevent any scope of injury, harm or accidents from occurring. While
devising an appropriate WHSMS data needs to be gathered and reviewed from
the organizations past records. According to data gathered and reviewed
WHSMS areas or core elements can be decided upon by relating to incidents
types. WHSMS procedures need to encompass the following procedures;
Store related procedures
Record related procedures
Management of WHS needs to be segregated according to this procedure. Health
and safety of workers needs to be developed according to strategy developed.
Employees and store managers three types of activities need to be covered in
WHS, ongoing activities, daily activities and yearly activities.

The WHSMS core elements while responding to the below employees can be said
to be as below;
Store Manager, Amanda Kaisig
The Store Manager of the Flagship Store, Amanda Kaisig hints at poor record
keeping practices of Pitstop. However, she highlighted the major areas of
concern as below;
Lack of awareness related to environmental laws
Lack of training for all processes of operating of pipes
Lack of capability to deal with vastness of operations
Lack of awareness regarding Victorian WHS Act and Regulations
Inadequate and inappropriate WHs procedures adaptation
Unawareness of St. John’s first aid course
worker representative, Pat Lee
Worker representative Pat Lee has detailed understanding and working
knowledge of employees as he has met with 40 workers from former ISS stores.
He has first-hand list of the concerns of the employees, which can be
incorporated into the WHSMS procedures. Major point of concern includes;
Absence of clear reporting and legal considerations in regards to WHS
Absence of feedback from General Manager or the board of directors
regarding health and safety as there have been no written procedures.
Lack of training amongst workers on ways to operate on machineries,
such that safe environment can be established. Also WHS policy and
procedures were not provided during induction or training procedures.
Prevalence of fear from injuries that deter workers from remaining
present or fully committed.

3.0 Draft of WHS policy
According to Victoria’s WHS policy regarding occupational health and safety
standards of employees. The Occupational Health and Safety Act 2004 (Vic) and
the Occupational Health and Safety Regulations 2017 (Vic) applies to all
Victorian workplaces. ISS buyout stores have retained all work related health and
safety procedures, which needs to be followed within the organization while
dealing with various materials. However, the organization also needs to include
appropriate recording and reporting of incidents along with procedures for
dealing with the same. For every incident there needs to be a record developed
and maintained. Such records need to be present across all stores and offices
such that everyone can review it. Moreover, a copy of WHS policy and procedure
handbook needs to be maintained such that it can be consulted every time
during occurring of an incident. A legal team for dealing with WHS policies and
procedures and settling any claims on disputes needs to be provided. This will
ensure that claims can be settled easily and more conveniently. A worker’s
representative, who can provide each case of employee facing health or safety
related challenge to the board of directors or senior manager needs to be
decided upon. Such a representative will help settlement of disputes in case any.
