HEALTH CARE 3Task 1: LO1: Understand how the design and review of services promotes and maximizes the rights of users of health and social care services1.1The legislation in UK has a large impact on the maximization and promotion of rights of users ofhealth and social care services. There are various acts and standards, which are effective in thiscontext. The example, which is taken into consideration here, is of residential care thereforesome of the legislations can be applied on this. These legislations can impact the rights servicereceivers of health and social care service (Carpenter, 2010). One of the legislations is The DataProtection Act, 1998 that has made efforts to safeguard the confidential information of serviceusers in the health care setting. This act states that sensitive and confidential data, which mayinclude diagnosis information, patient records, financial information of patients and otherinformation of patients, should not be given to any other party without the permission of serviceuser (Drummond, et al, 2015). Apart from this, other legislation is The Equality Act, which was come in existence in the year2010. It is another legislation that has assisted to safeguard the rights of the service receivers inhealth care organization. As per The Equality Act, the health and social care service receiversshould be treated equally. It states that people should not be discriminated on the basis of theirrace, age, origin, ethnicity etc. This legislation determined several norms for protecting the rightsof disabled person. It is playing an important role empowering people against inequality anddiscrimination during treatment and health care service (Glasby, 2012). Due to these regulationsand acts, the service users are able to enjoy an equal and free health and social care from serviceproviders. In addition, there are some other regulations, like; Human Rights Act, 1998, Safetyand Independence act, 2005, Medication Administration Act, 1988 etc. By complying with theselegislations, the residential care service providers can provide the care effectively. 1.2There are so many factors, which could affect the attainment of rights of users in health andsocial care services. These factors include behaviors and qualifications of service providers, ruleand regulations, communication model used by organization and working environment (Staley,2009). As mentioned above, the laws and regulations, like; Data Protection Act and Equality Act
