services
1.1
The legislation in UK has a large impact on the maximization and promotion of rights of users of
health and social care services. There are various acts and standards, which are effective in this
context. The example, which is taken into consideration here, is of residential care therefore
some of the legislations can be applied on this. These legislations can impact the rights service
receivers of health and social care service (Carpenter, 2010). One of the legislations is The Data
Protection Act, 1998 that has made efforts to safeguard the confidential information of service
users in the health care setting. This act states that sensitive and confidential data, which may
include diagnosis information, patient records, financial information of patients and other
information of patients, should not be given to any other party without the permission of service
user (Drummond, et al, 2015).
Apart from this, other legislation is The Equality Act, which was come in existence in the year
2010. It is another legislation that has assisted to safeguard the rights of the service receivers in
health care organization. As per The Equality Act, the health and social care service receivers
should be treated equally. It states that people should not be discriminated on the basis of their
race, age, origin, ethnicity etc. This legislation determined several norms for protecting the rights
of disabled person. It is playing an important role empowering people against inequality and
discrimination during treatment and health care service (Glasby, 2012). Due to these regulations
and acts, the service users are able to enjoy an equal and free health and social care from service
providers. In addition, there are some other regulations, like; Human Rights Act, 1998, Safety
and Independence act, 2005, Medication Administration Act, 1988 etc. By complying with these
legislations, the residential care service providers can provide the care effectively.

There are so many factors, which could affect the attainment of rights of users in health and
social care services. These factors include behaviors and qualifications of service providers, rule
and regulations, communication model used by organization and working environment (Staley,
2009). As mentioned above, the laws and regulations, like; Data Protection Act and Equality Act

are empowering the rights of users and ensure that no one is being discriminated. Another factor
is behaviors of employees in enhancing the rights of users. Their attitudes impact, when they
work in the organization (Figueras & McKee, 2012). Furthermore, it is very important to
establish an effective communication between service receivers and service users. If health care
services are provided in effective way, service providers will be able to understand the needs of
people and how they can promote the rights of service users by providing feedback and
analyzing health care services (West and Turner, 2010).
1.3
Communication is an important factor in the service delivery of any organization. There should
be an effective communication between care providers and individuals to give effective services
to service users. It may include many methods and techniques, like; informal, formal, verbal and
non-verbal communication between the service receivers and health care organization. It will
contribute in maximizing the rights of service users. One of the important techniques is
implementation of translation service (Glasby, and Dickinson, 2014). It would promote the rights
of users by utilizing different communication channels and methods. It may be possible that
users can speak different languages. So, this service will assist the people in communicating their
requirements and opinions. For effective communication, there should be an effective feedback
and complaint system, so that patients can develop the service delivery better that can promote
their service rights (Dziegielewski, 2013).

Health care organizations have implemented different managerial approaches to eliminate the
harms and risks, which are available in the health care setting and for the protection of service
receivers and employees from the risks and harms of above given factor. One of the major
interventions, which can be recognized, is to prepare the risk assessment sheet. This is the sheet
which is prepared in the organization as per the instructions of Health Care and National Health
Service regulations and legislations (Jackson & Segal, 2014). Under Risk assessment, the
organizations can identify all the harms and risks, which are available in the hiring the
employees and developing security and safety measures for the patients. By this, these risks and
harms can be avoided. It provides the service users data about that how they can safeguard their
health by making efforts before any incidents. Under this approach, the organization makes
proactive arrangements; the risk assessment can be recognized as most effective intervention for
the management of risks and harms to health care (Moss, 2007).
Apart from this, company can create confidentiality policy, which states that all the members of
staff should be aware about their duties and responsibilities for safeguarding the private
information and confidentiality (Munn-Giddings and Winter, 2013). These policies will be very
much effective for the organization to develop a managed and effectively organized management
system, which will help the organization in keeping the staff and patients safe from harms and
risks in their workplace environment. Along with these policies and approaches, the health and
social care settings can execute some safety and security measures and comply with the related
laws and regulations (Sketris, Langille Ingram and Lummis, 2009)

Task 4: LO4: Understand how good practice in the administration of
medicine is essential for users of health and social care services.
4.1 Brochure:

There are several policies and acts, which are identified in the above-given brochure. These acts
are applied effectively for managing the medication within health and social care organization
(Hancock, et al, 2006). These legislations are very much effective in different ways, such as;
these acts are helpful in attaining higher quality of health and social by establishing many
standards. Complying with different regulations assists the health care setting in effective
utilization of resources and management of the health care costs. In addition, these policies help
in playing the role of national patient safety agency, whose major objective is to offer security to
helpless people in an effective way (Cipolle, Strand, and Morley, 2012). One of the major

objectives of these acts and policies is to provide an appropriate medication, maintain the quality
of medicines and make the service users safe from issues related to medicines. These policies are
very effective in managing the medication and providing the rights medicines to right people
(Deegan and Drake, 2006).
