INTRODUCTION
Health and safety are important parameters of human life as they are responsible for
smooth functioning of an individual. This assignment will cover different aspects of Fleet wood
Hall care home. One of the most important factor of health care come is the implementation of
Health and Safety at Work Act (Goetsch, 2010). This act was established in 1974. Under this act,
different duties and responsibilities are assigned to employers, employees, contractors, suppliers
of goods and substances for use at work. This act was enacted in order to secure health, welfare
and safety and protect employees and other workers working in an organisation. It helps in
identifying potential risks within workplace and working on ways in which the risk can be
minimised or eradicated.

2.2 Impact of one policy on the customers and work of practitioners.
Recruitment and selection policy: Fleet wood Hall care home is having good recruitment
procedures but requires talented candidates which can provide better services to patients.
Because of this, managers have to perform external recruitment which can hire talented and
highly skilled candidates which have desired skills and knowledge in health and safety field.
Advantage of this policy is that, it will provide fresh talents and ideas to care home and
they can develop better care plans which will be beneficial for patients.
Disadvantage can be that, Fleet wood Hall care home have issues with employee
appraisal and staff training was also not up to the mark. So, new candidates might not join the
care home due to lack of these things (Barba and et al., 2015). It is responsibility of a manager to
develop better appraisal systems that can attract new candidates and also retain previous
employees. They can also provide them with necessary health and safety training which can
enhance their knowledge regarding this field. This will ultimately improve their knowledge area
and also improve the service providing by them.
2.4 Impact of Non-compliance health and safety legislation
Non-compliance with health and safety legislations refers to certain rules and regulations,
guidelines and more that are not followed by a company. These legislations are enacted by
Health & Safety Act 2008 that amends a firm to follow set rules and drive their business as per
manner. According to this act, all organisations are needed to make their workplace safe from

discriminations which may occur on the basis of different backgrounds of employees like age,
sex, colour and more. In addition to this, it is necessary for management to provide essential
training to all associated workers so that they can protect themselves from harmful situatios. If
such associations disregarding these laws and driving in own way then after a set period they will
get a notice and have to pay fines and penalties against the same (Dollard and Bakker, 2010).
Non-compliance at workplace includes lack of safety equipments, unprotected work areas and
untrained employees. As per present scenario, it has observed that In Fleetwood Hall Care
Home, some issues are occurred at workplace like untrained nurses and staff at premises,
unhygienic conditions due to which employees feel unsafe and more.
Impact of Non-compliance-
Health and safety Act 2008 has made with aggressive purpose i.e. to protect employees at
workplace from harmful issues and hazardous conditions. If a company do not comply business
with such safety guidelines then there is a potential for a people associates with organisation to
get severely injured. In such conditions, such associations face a heavy labour turnover. While, if
they will follow set guidelines then workers feel much happy and safe to work under such
workplaces. In general, non-compliance impact in both positive and negative manner on a
business in following manner:-
Positive impact: When a firm drive business as per set guidelines then it will help in
providing a safe working environment to people at workplace. It will also aid employers in
maintaining an effective communication between management and workers so that whole
process of function is carried out in effective manner (Wilkins, 2011). In context with practising
RIDDOR i.e. Reporting of injuries, diseases and Dangerous Occurrences Regulation which assist
a company to give a report if any such activity act in business with people that causes physical
injury. It will help in identifying where and how such incidents arise so that need of investigation
can be evaluated. Thus, using this policy helps a firm in improving operational activities and
creating a better or safe working environment for workers. This will impact directly on
organisational performance as if employers of a company like Fleetwood Care Home implement
new policies and equipments then it will affect day-to-day operations of employees. It has
analysed today that major cause behind hazardous situations that could harm workers and other
people in a firm are chemicals, fumes, dusts, mists, nanotechnology, vapours and more as per
given under COSHH. It stands for 'Control of Substances Hazardous to Health' which amends

employers to prevent workers from being exposed to such substances. In addition to this, it is
necessary for an organisation that if any such activity happen with a worker which causes injury
to them then employers have to pay their medical costs and other expenses.
Negative impact: In case if any staff member gets injured at workplace and such
company is not in compliance with safety laws then such people have to pay for medical
prescriptions which affect their financial conditions. This would generate insecurity in other
workers which may lead to heavy turnover in such companies. In addition to this, it will also
affect reputation of business in marketplace also. As per present case study, an inspection has
been carried out by a team of CQC (Care Quality Commission) who has evaluated that
workplace of Fleetwood Care Home is unhygienic which leads to cause several diseases and
have untrained workers also. Therefore, they give a legal notice to employers of this institution
to make improvements in the same otherwise registration of their business will be cancelled.
This affect shows negative impact of Non-compliance in a company.
Thus, Fleet wood hall care home is a home for patient of dementia, mental health and
nursing unit which have 14 people in general nursing unit. As it is a home which provides health
and acre service to people, they can implement above priorities within campus in order to
prevent harmful impacts on patients (Geldart and et. al., 2010). Managers can provide proper
training to employees regarding fire safety and first aid so that they can manage those situations.
3.1 Way of health and safety is monitored and reviewed in an organisation
Monitoring and review is considered a part of risks management process which involves
procedure of regular checking at workplace. It includes major components like planned,
documented and approved. Monitoring can be defined as continual checking, critically
observing, supervision and determining status for identifying changes in business so that
performance level can be improved. While activities used in determining adequacy, suitability
and effectiveness of functions carried out to accomplish an objective is termed as review.
Ways of monitoring and review: To review progress of business, a company needs to focus on
day-to-day operations of business, management can take various methods like creation of
dashboard, competitive analysis, analysis of HR, marketing expenses, analysis of overhead and
more. In context with health and safety at workplace, CQC team can monitored and reviewed in
following ways:-

Audit: It refers as a process where scheduled checking is done about regulatory aspects
of health and safety in an organisation to ascertain that all the regulations are fulfilled in true
sense to get maximum benefit. As per present scenario, CQC team use this various activities in
auditing to analyse condition of health and safety. It includes OHS Committees, Incident
Reporting, Training and Awareness and more. It will explicitly monitor that monitor process for
harmful and hazardous identification, risk assessment and control etc. are being used at
workplace. In addition to this, management of a company used to setup and meet performance
standards in proper manner so that progress is being made.
Spot Checks: Under this condition, inspection team of CQC can made an investigation in
an organisation without a prior notification (Zanko and Dawson, 2012). This would done to
identify condition of workplace and record hazardous issues so that corrective actions can be
taken. In this process, investigators pay more attention to such items which may cause hazards or
have potential to develop unsafe conditions due to chemical reaction, heat, corrosion and misuse.
Hence, by inspection it has evaluated that workplace of Fleetwood Home Care is not safe, there
is uncertainty in sanitary and hygienic condition of premise which may cause infection to people
who use the same. Along with this, staff members are also untrained as no essential training has
given to them to protect own from hazardous situations.
3.2 An analyse on positive health and safety culture
Culture of a company reflects overall environment of a workplace i.e. way of
communication occur among workers and managers. It also shows how much employees share
bond with each other and help in carrying out an activity. A positive culture results in
collaboration among staff members as they will affectively carry out assign task given to them.
It will also aid in generating feeling of respect among each other through which effective
relationship can be developed. Thus, if a firm has positive culture than it will increases
satisfaction among workers which will help in gaining their retention for long time also. While in
context with Safety culture, it can be defined as the way through which safety is managed at
premises (Arocena and Núñez, 2010). It includes proper equipment, comply business with
necessary rules and regulations as well as safe practices are carried out by management. In this
kind of culture, staff members will feel more safe.
In order to run business well, management of Fleetwood Care Home is necessary to
develop positive health and safety culture at workplace. They must concern on sanitary condition

of premises and provide different wash-rooms to staff members so that hygienic conditions can
be maintained (Estrada, 2011). Along with this, employers are required to run business by
following set guidelines given by Health and Safety Act 2008. They should include some
practices like RIDDOR, COSHH, good management and more. In regular interval of time, they
must require to induce some activities to monitor and review performance of business through
which risk assessment can be identified and controlled. Managers should provide training and
learning program to nurses, workers staff and other people. In order to measure safety at
workplace, a firm can use Safety Climate Tool. This technique provides an objective to analyse
'way things are done in workplace'. It includes:

This tool will generate a report in written form which provides guidelines for
improvement in safety culture at organisation (Bjerkan, 2010). Thus, it will help in raising

From the above assignment, it can be concluded that health and safety are crucial
elements of human beings and are necessary to maintain at home as well as at workplace. Above
assignment is based on Fleet wood Hall care home, in which there are several problems and
issues that are required to be improved. As they are providing services to patients, so they have
to very careful and precise about the services and care they are providing to the patients.
