Introduction
Travel and tourism sector play an important role in the
economical growth of the country. It is required to provide help
to the travel and tourism sector by the government. Travel and
tourism sector is the key part of the government that generates
revenue for the government. When the adequate protection is
provided to the travel and tourism sector then it can work more
frequently with the achievement of their goals.

1.1 Legal systems of tourism sector in UK
The legislation and the industry that are in tourism sector are inter related
somehow. There are many things that are covered under tourism sector like
organisation, consumer, hospitality sector. When these factor interact with each
other then legislation took place. Example- restaurant provides the food to their
customer as well as provides the services related to it. Legislation governs many
sectors as behaviour of the consumer, hospitality sector, quality as per the
standard.

Legal framework covers the decision making process but the regulatory
framework provides a system to enforce the legislation. The country has
enforcement many legislation and laws in travel and tourism sector.
The objective behind the incorporation of legislation are as follows-
To provide the standard procedure that is required to follow by the tour
operator.
To provide the right and duties of the organisation toward their customer.
To make the development of tourism sector in regulated manner.
To provide remedies to the customer if their rights are infringed.

Tour operators of the UK are abide by the following legislation as-
Development of tourism act 1969
This act is introduced by the British tourist authority. This act provides help to the tourism sector so that this sector can be
developed over the time. It has main focus on the co-ordination among the various sector that are involved in tourism
industry.
Transport act 1980 and 1985
This act provides the licensing laws that are required to follow to the industry. It is required for the organisation that is dealing
in transport industry to take the licence for the same. This act affected the coach routes and travelling over 30 miles. It
increased the competition among private bus and national bus company. It allowed private buses to operate in all routes.
Package travel, holidays and tours regulations 1992
This regulation provides the responsibility that the travel operator has toward the customer. It also covers the remedies that
are available to the customer if they face any issue.

1.2 Surface, sea and air transport law of UK
There are many ways that involved in carriage of the passenger, passenger can
be carried through by the way of surface, sea and air ways. These ways are very
important and helps to the passenger to carry them to the destination. It is
required for the travel and tourism company to make the innovative things in
their business so that passenger can be attracted toward the organisation.
Passenger means the person who is carried by the company to the different
destination.
Carrier is the person who involved in contract of carriage.

Surface Law:
This law is governed by the carriage and passenger by road act 1979. it provides
protection to the passengers who are carried through by any surface mean. The
passenger who are on board with the permission of carrier is liable to indemnify,
if they face any issue. It provides the protection to the passenger in case of
physical and mental disorders, damages while travelling etc. The carriage by rail
act, 1972 governs the issues that are faced due to the loss of luggage. The
railway privatization has focus on the development and integrating the transport
of goods and passenger. It also provides adequate protection to the disabled
person.

Sea Law:
This law provides the protection to the passengers who are travelling by any way
of sea. It is important to provide safety to the passenger who going through ship.
This law considers the environmental factor that are at the time of functioning of
the ship. Fire protection measures are governed by the international convection
for safety of life at sea. The issue that are faced by the passenger while travelling
are governed by the Athens convection 1974. it also provides the liability of the
crew toward the passenger when they face issue. It is mandatory for the person
who are travelling through the ship to be insured. This law provides the limit of
the liability of the crew.

Following are the liability of the carrier:
It is the liability of the carrier to indemnify the passenger if any loss is
occurred to them due to the negligence of the carrier.
It is the duty of the carrier to pay for the losses to the passenger, if the loss is
occurred during the course of carriage.
The person who is suffering from the loss shall be the liability of the carrier.
