Question 1
The American Disabilities Act (ADA) of 1990, is a law for ensuring civil rights of
citizens and covers the prohibition of discrimination against individuals who have some form of
disability. The ADA provides coverage for discrimination against disabled individuals across all
aspects of public services and lifestyle, which include schooling, employment, transportation
services and all spaces prevalent across private and public levels which are accessible to citizens
(Keenan et al. 2019). In comparison, Section 504 of the Rehabilitation Act prevents
discriminated against disabled individuals availing services in organizations receiving funding
from the federal government. Hence, a major difference between the ADA and Section 504, is
that, while Section 504 limits discrimination only to federally funded organizations, the ADA
expands prevention of discrimination to all fields of public life (DuPaul et al. 2016).
Question 2
While Section 504 prevents accommodation and discrimination against children with
disabilities while the IEP provides an individualized and specialized education program for
children with severe disabilities requiring comprehensive assessment. To explain a parent, the
following example can be considered: A child with a partial hearing disability can obtained
accommodation services like separate seating under Section 504. However, a deaf blind child has
a more severe disability and hence, will require specialized education under the IEP for ensuring
academic proficiency (YouTube 2019).
