Q1. Children and other vulnerable people need special protections:
a. List three (3) South Australia and/or federal specific legislation regarding
children and young people.
Right to child health and social welfare

b. Hundreds of applicants apply to work as nurses, child care educators every
day. How does the south Australia State legislation ensure the safety of
children and vulnerable population against applicants with a history of
criminal activity or child molestation?
Section 8B of the Children’s Protection Act 1993 indicates that all the
organizations whether governmental or non-governmental that provide
services to children are required to undertake a history assessment that is
relevant for all the people in their organizations who volunteer or work in
prescribed positions. (one who is not directly supervised at all times but has
regular contact with children). A relevant history assessment should also be
undertaken before a person is appointed to act in a prescribed position in the
organization.
A prescribed position can also be someone, supervisors or managers who
works in the close proximity to children regularly and are not directly
supervised at all times. it can also be someone who has access to records
relating to children this is according to Tilbury, (2014)
c. Describe what mandatory reporting is, who is required to report, what they
are mandated to report.
This is a legislative requirement for selected classes of people who deliver
their services to children as their professional work such as health care staff
(for example nurses, educators including teachers, law enforcers and even
welfare authorities such that they can report suspected child abuse and
neglect to government authorities.
d. Name the legislation that describes mandatory reporting requirements in
South Australia.

The code shows professionals how to carry out their roles and responsibilities under
the Mental Health Act 1983, to ensure that all patients receive high quality and safe
care.
B) List examples of two (2) South Australia and/or commonwealth
legislations, and two (2) standards that apply to mental health.
The two legislations in south Australia governing how people with mental health
conditions should receive care and treatment include the Mental Health Act 1983
that was updated by the 2007 Act and the Mental Capacity Act 2005, that includes
the Deprivation of Liberty Safeguards.
Mental Health Act sets out standards that including ensuring that any detention and
or treatment that is done under the Mental Health Act complies fully with both ‘the
Act’ and the safeguards as set out in the code of practice.
The Mental Health Capacity Act allows somebody to make a decision on behalf of a
person aged 16 and over in their best interests, this is if the person lacks the
capacity of making the decision for themselves.
C)Another vulnerable population is older people, particularly if they are in care.
Name the Commonwealth Act that describes special obligations and
considerations for aged patients.
Aged care Act 1997 (the Act).
D) Name one South Australian and/or Commonwealth legislation regarding the
non-professional carers (usually family members) of older people, and people
living with disability.
The unpaid non-professional carers are supported by Carer Recognition Act
2010.
Q4. Continuing professional education opportunities are important in nursing
practice to attain your registration. How many hours of continuous professional

Q5. A) According to the codes of professional conduct, Nurses ought to respect the
dignity, culture, ethnicity, values and beliefs of people receiving care and
treatment, and of their colleagues. Explain this code in less than 100 words.
This is provision of the code of ethics where the nurses not only practice respect but
also compassion for the inherent dignity, worth and attributes that are unique to
every person encountered.
Nurses can build a foundation of trust as they build patient relationships by setting
aside all biases and prejudices.
Nurses can help patients live with sense of well-being possible by minimizing
treatments that are unwanted and unwarranted or by ensuring that the patients are
receiving optimal care regardless of their illness, proximity to death or
socioeconomic status.
Nurses can maintain goog relationships with their colleagues and collaboration with
other healthcare providers to help build ethical, compassionate and effective
medical environments.
B) What federal and state law/s apply to ensure that people in S.A are not
discriminated against on the basis of culture, religion, or ethnicity?

It aims to promote right to equal opportunities to everyone. It eliminates
discrimination, sexual harassment and victimisation.
Q7. Define the following with appropriate examples
Negligence- Negligence is the inability to take care of the patient or client
reasonably and in the process cause loss or more suffering to the patient or
the client. For instance, you are supposed to administer morphine to a female
patient with breast carcinoma at 8.00am but u failed or delayed thus causing
the patient to suffer more from pain.
Duty of Care- Duty of care is a legal responsibility endowed to an individual,
institution or an organization to maximize service or products to the people
or consumers while minimizing risks or harm. For example, nurses in the
hospital should have a well written care plan to facilitate proper care of the
patients.
Vicarious liability- Vicarious liability is defined as legal doctrine that involves
the employers being accountable for the acts of their employees in a
company or an institution. For example, if a patient in a private hospital
develop a disability in the process of treatment due to negligence the
hospital can be sued and it will be able to compensate the patient on behalf
of doctors/nurses who attended to the patient.
Q8. What does the Australian Charter of Healthcare rights say about access to
healthcare?
A right to access healthcare for the patients, consumers and other people using the
Australian healthcare system. This is to ensure that whenever or wherever
healthcare is provided, it is always of high quality and is safe.
Q9. A) What is the policy of the Australian Nursing and Midwifery Federation
regarding informed consent? Enlist the types of consent.
Patients should consent to all medical procedures and have a right to refuse,
exception is during emergency or when a court order is obtained for
treatment that is determined to be medically essential.
According to Heaton, (2014), the three types of consent are; implied consent, verbal
consent and written consent
B) What is needed for consent to be valid?
Consent must be informed; the patient has to understand what the procedure
entails and its risks that are involved with the performance of the procedure. It
has therefore to be explained clearly in a language that the patient or patient’s
agent understands.
