INTRODUCTION
P1 Explain the legal requirements and regulations for ensuring the health, safety and security of
those employed in business
There is a need of legal requirements of a company in an organisation. In every
organisation the organisations have various problems like deaths, injuries, occupational diseases
and dangerous occurrences and this helps in identifying how and where risks occur in the
workplace. Any kind of accident or incident which takes in a workplace is responsibility of
employer and there should be no such kind of activity that should occur in the workplace. Some
legal rules and regulations are made for employees for making them feel secure and safe in the
workplace. These are required for health, safety and security of employees of business. It is
important for a company to analyse various health and safety regulations for ensuring the
positive environment at workplace. The various regulations followed in an NHS hospital are
described below-
Health and Safety at work regulations, 1999
Health and safety in a workplace are required in each and every organisation. It is
important for every organisation to understand responsibility of every employer. Employees of
the company nowadays have more rights to fight against any discrimination that occurs with an
employee. There are different responsibilities of employer as well as employees. In context of
NHS hospital all managers and staff are given equal rights to do their work effectively while
treating patients in an appropriate manner. The management of this hospital manages and
reviews that no danger and hazard can affect staff of this hospital.
Health and Safety at Work act 1974
According to this regulation, employees can protect their rights and rules at workplace.
This regulation is put into place for reducing harm and requiring assessment of all potential risks
and creating action plans if any emergency occurs. This regulations puts duty on employers and
managers for analysing risk that can harm workers and staff of the hospital. The employers of
NHS hospital ensures that health and safety of worker is the most important thing as they are
most essential asset of the organisation. A healthy employee will work more effectively.
Workplace Regulations 1992

According to this Act, different workplaces have to adopt some basic requirements that
will help in doing work in an organisation effectively. The different facilities provided at
workplace to staff and employees are reasonable temperature, room space, lightning, cleanliness,
seating, workstation, etc. the main objective of this regulation is to provide welfare to employees
and staff. The employees can work more accurately if they are getting all basic needs and
requirements.
Reporting of injuries, diseases dangerous occurrences regulations 1995
According to this regulation, various duties of employers, self employed and individuals
in control of work premises for reporting in a certain workplace accidents, dangerous
occurrences and occupational diseases are recorded. The individuals and premises must keep
records of the following activities -
 work related accidents which cause death
 work related accidents that cause certain serious injuries
 diagnosed cases of certain industrial diseases
 certain dangerous occurrences

Every business organisation seeks to develop healthy environment for employees so that
they can work effectively without facing much trouble for the same. With reference to NHS, it
has been analysed that there are numerous of requirement for a healthy and safe workplace
environment in order to make it easier for employees to work in effective manner. This clearly
means that requirement of healthy and safe workplace relies upon three different types which has
their own sub section. All three kind of requirement are described below in detailed manner.
Physical environment requirement: It can be said that management team of NHS is required to
focus on providing healthy environment to employee so that can work effectively without facing
trouble at the time of performing the work.
 Impact of working environment- It is essential for employer to create healthy working
environment for the company so that they can easily perform and attain their business
objective in effective manner. Here, in order to convert effective environment both the
employer and employee has to take equivalent initiative so that accidental cases can be
reduced at workplace. These accidents might occur because of moving objects, hand tools

and falling objects. All of these incidents could develop negative influence over the
working environment in negative manner
 Evacuation assembly areas: It has been analysed that in every industry lots of people
dies due to carelessness of employees. Therefore, it is essential for the company to take
certain initiatives so that influence of these can be minimised in less period of time.
Equipments requirement: It has been analysed that for developing an effective environment at
workplace NHS requires numerous of equipments so that a healthy environment can be
developed in effective manner. It is important for employees of NHS to take certain safety
guards. Safety guards are the individuals which like works bouncers at workplace so that
preventive measure can be taken at the same time. Along with this, employees are also suggested
to wear protective clothing so that any harmful chemical can not harm them in negative manner.
In addition to this, fire extinguishers are also required to be used in the NHS so that at the time of
any uncertainty. Emergency exits are also required to be owed by the hospital so that if in any
case any uncertainty can be avoided as people will be having space to run and save them selves
from the emergency exit options. Apart from this, warming signs and sound signals can also be
used by business organisation in order to inform each and every available hazard or unhealthy
situation. In this regard, management of NHS is required to conduct some meeting in which each
and every employee is require to trained about different signs which are going to be used in
different situation that are not good for employees as well as employers.
Legal requirement: At next, it is essential for management of NHS to follow certain acts in order
to ensure that overall workplace is safe for all so that employees can work freely without facing
any difficulty. Some of the core acts which are required to be considered by NHS management
team are Data Protection Act 1998, Computer Misuse Act 1990, Copyright, Designs and Patent
Act 1988 and Freedom of Information Act 2000. It can be said that all of these acts will
contribute in developing positive working environment for workers. In addition tio this,
implication of these acts will ensures that morale of employees will be developed in effective
manner that enhances their productivity at workplace of effective manner.

It is very important to provide healthy, safe and secure environment to their employees,
visitors, and staff members. It is applicable to each and every organisation, so that they can retain

their staff members for a longer period of time in an effective manner. However, staff members
do have their duties and responsibilities towards their health and safety. In the present context of
NHS, it is one of the biggest health and social care organisation established with the motive of
serving to people. There are some roles and responsibilities regarding health and safety which
are as follows:
As an employer there are some responsibilities which need to be followed by them in an
effective manner. These responsibilities and duties are as follows:
 It is the duty of a manager to provide clear instructions so that they perform their task in
an effective manner.
 Provide effective supervision to their staff members, which includes new workers,
inexperienced employees.
 Give tailored health and safety training sessions to their employees which is relevant and
up to date.
 Provide up to date data and information which is required by staff members of NHS
while dealing with visitors.
 It is very important for them to appoint a person who have skills, knowledge, experiences
and capabilities in order to meet healthy and safety measures.
 Should have some emergency signs and signal which need to be understood by every
person working in the organisation.
 It is also very essential for the managers to provide facilities which includes toilets,
washing facilities, first aid box facilitates and many more.
 For a employer, it is required to have up to date knowledge about work safety and health
measures.
 Managers of NHS set some specific standards and than examine these health and safety
measures on a regular basis.
 It is the managers responsibility to ensure that the organisation follows health and safety
policies which is provided by the board members.
 It is also very essential to follow the upgraded policies implemented by government.
On the other hand, there are some responsibilities which every employees must follow in
order to perform their task effectively. Employees and staff members of NHS have the duty to
take care about their health and safety. It is also very essential to co-operate with other staff

members and aid them to meet up with their legal requirements in an effective manner. Some of
these responsibilities are as follows:
 They must follow health and safety measures formulated by the top authorities of the
company.
 In order to follow all these measures, they need to be highly skilled, educated and well
trained.
 It is necessary for the staff members to take care about their own health and safety while
working within the organisation,
 Co-operate with your colleagues and new joiners and help them to understand about the
measures adopted by the company in relation to health and safety.
 Immediately inform your top authority about the problems arise within the organisation
in order to follow health and safety measures.
 In order to perform their task effectively it is necessary for the staff members to have
effective knowledge about adopted measures.
 It is very essential for the staff member to participate in training sessions, organised by
the employers in order perform assigned duties effectively.
 Inform the manager and top authority if any kind of hazardous chemicals are used by
anyone within the organisational premises.
 It is an employee right to ask your manager in order to remove hazardous chemicals.
As per the above mentioned report, it has been examined that all these responsibilities are
needed while performing their task in an effective manner. Both employer and employee must
have their responsibilities which need to be performed by them effectively.

As per the above mentioned report, it has been analysed that health and safety plays very
important role while performing hazardous work in the organisation. While performing any
difficult task, it is very necessary for the manager to provide healthy and safety measures. With
the help of this, they will be able to perform their assigned task effectively with the help of safety
measures. In this report it has also been identified that there are some legal requirements,

regulations and laws which need to followed by every organisation in order to maintain their
sustainability at the competitive marketplace for a longer period of time. Apart from this, it has
also been mentioned in this report that what are the requirements in order to develop healthy and
safe work environment with the help of physical environment and equipments. As well as this
report identifies various roles and responsibilities of employer and employee working within the
organisation. This as a result, will aid them in performing their task in an effective and essential
manner. At last it has also been examined that, there is a plan for risk assessment within the
working organisation.
