3. Listing the requirements to comply with the Food Act
The requirements to comply with the Food Act include:
1. Food Standards Code
2. Registration/Notifications of fixed food premises
3. Restaurant and Cafe license

Complying with these requirements is essential so that proper licensing can be
obtained and longevity of the restaurant can be maintained.
4. Listing the process and requirements to obtain liquor licence
The obtaining of liquor license can be classified based on the type of liquor that is
being sold. For example, in Victoria, in order to gain liquor licence it is necessary that the
establishment holds a BY permit under the act (Vcglr.vic.gov.au 2019). The requirements
need to comply with the Responsible Serving of Alcohol course in the previous financial
year. However, at the end of every year the license need to be renewed.
5. Listing the types of insurance required
The type of insurance that is required for a restaurant to maintain includes:
 General liability insurance
 Product liability insurance
 Inventory insurance
 Liquor liability insurance
 Commercial insurance
 Register for work cover insurance
These insurances can help in preventing any type of damage to the restaurant and
ensure that the legal practise obtained by the restaurants is maintained.
6. Providing an overview of the legal tax obligations and penalties
The legal tax obligations in Australia are based on the returns to the taxes made along
with the wages and salaries provided to the employees (Ato.gov.au 2019). The penalties that

can be imposed in case of failure to meet the tax obligations include monetary payment up to
$10,000 for misguided information as well as failure to comply with the notice given to pay
the taxes.
7. Listing requirements to comply with the Fair work legislation
The Fair Work legislation governs the employee and employer relationship in
Australia (Legislation.vic.gov.au 2019). The requirements that need to comply with the Fair
work legislation include:

 Fair Work information statement
 National Employment Standards
 Small Business Fair Dismissal Code
 Fair Work Amendment Act 2009
 Independent Contractors Act 2006
 Freedom of Information Act 1982
8. Listing the WHS requirement
The Occupational Health and Safety Act 2004 are followed in Melbourne to ensure
safety of the employees working in restaurants (Business.gov.au 2019). The requirements that
are to be maintained in Melbourne Australia include ensuring the safety of the employees
from any type of accidents such as burning. For this it is essential that the restaurant provides
protective gear and comply with the WorkSafe policy that is applied in Victoria, Melbourne.
9. Identifying areas that require provisions for risk
In the restaurant the areas that require the provision of risk includes the kitchen as
most accidents tend to occur in that particular room. For example, employees may suffer
from burn while cooking and it is necessary to make provisions that comply with the

Occupational Health and Safety Act 2004 (Business.gov.au. 2019). Provisions such as
wearing protective gear and maintenance of a regular check of equipments that are used in
the restaurants can be taken into consideration to reduce any type of threat in the restaurant.
10. Identifying areas that require legal advice
Specialist legal advice is needed in areas that deal with taxation, WHS regulations,
provisions for music and gambling along with licensed food act. The reason for seeking legal
advice from specialist people in these areas is mainly because these areas are critical to
understand and any flaw identified in the application of activities related to these provisions
may account for imprisonment as well as fine for the restaurant (Ablis.business.gov.au 2019).
It may even revoke the license of keeping the restaurant in an active state.

Part C
1. System to be used for consistent evaluation
Operational non-compliance need to be maintained by developing compliance
programmes such as federal customer protection laws. Non compliance may result in
penalties that may involve financial loss as well as imprisonment (Ato.gov.au 2019).
Compliance audit can be used as a system to ensure consistent evaluation of the compliance
activities associated with the restaurant. The audit can help in checking the compliance
activities in a particular period of time and ensure that changes brought about be addressed
for the development of the restaurants.
2. Assistance of the systems
The adoption of the auditing process may help the restaurant to make rectifications
based on excess financial loss for the restaurant as well as for the development of mitigation
techniques in the future. For example, if the restaurant suffers from financial compliance then
the auditing can help understand the type of assistance needed and the reasons for the loss of
finances. Hence, future actions such as maintaining strict budget or increase in the price of
products can be made that can help in assisting with the intended modifications required to be
done in the business (Ato.gov.au 2019).
3. Ensuring to stay updated with the changes in the legislation
The legislation associated with the compliance need to be maintained and updated by
following any changes that may occur. For example, it is necessary to understand the

amended rules and regulations so that the restaurant can maintain its business activities based
on the regulations (Ato.gov.au 2019). The manager of the restaurant need to be well
acclaimed with the Government policies that define the consistency of the business and
ensure that regulatory provisions of the business such as that associated with the food be
maintained in the restaurant.
4. Ensuring consistency of staff members
The staffs working at different levels of the restaurant need to be kept updated about
changes in the compliance. One such action to maintain the update of the staff can be made
by providing them with relevant emails about the changes. This can help in keeping the
record of the change message and help in gaining feedback from the employees in terms of
understanding the changes that has been made (Ato.gov.au 2019). Along with this, a meeting
can be held between the employees so that they can understand the changes and act according
to the expectations on the changes.
5. Documentation to assist in managing compliance
Legal documentation such as contracts on the changes of compliance can be used to
manage the compliance in the restaurants. Continuous improvement can be achieved by
ensuring that monitoring of the practises adopted by the employees is maintained. It is also
necessary to ensure that the management set up rules and regulations that define the legal
rules related to the establishment of the restaurant (Ato.gov.au 2019).
