INTRODUCTION
Law of license is defined as the permission which is given to any of the specific person to
do something. It is necessary to obtained license because it does allow to do any of those work
which is against the law. In simple words, license is a legal permission to do something by
obtaining legal rights from the authorised department. The chosen organisation for the particular
project is Imperial Guest House which is one of the small and medium size hotel industries. In
addition the areas which will be covered within the file will be related with different types of
licensed premisses, difference between personal an premise license. There will also be the
discussion on procedures for licences application. In addition, various other sections will also be
covered in which it will relate towards the roles and responsibilities associated with the
management of licensed premises. Also evaluation will be don on the impact of food safety and
hygiene legislation.
TASK A
1.1 Discuss the different types of licensed premises
Any of the land, building, apartment, store and even grounds which is used for any of the
specific purpose is known as licensed premises. There are various types of license premises
which is explained in detail below: Hotels: Whenever there is the requirement of opening any of the new hotel it is necessary
that hotel must try to have a overview that what are those area of laws which can be
applied on them. Some of the laws and licences which is required to be obtained is
related with food hygiene and fire regulation. In this case, if hotel fails to fulfil any of the
term and condition then they will fall under the category of breach of laws and duties
which has been assigned to them. Here, action can be taken either through the process of
civil law or criminal law (Hotels Laws UK, 2018). In short, it is necessary for any of the
hotel to take business license to run any of the hotel.
 Restaurants: The law of license says that obtaining the license is most and when it
comes to restaurants, business license is required to be obtained. The license helps
directly to the owner that how they are required to operate and what are the laws which is
needed to be followed.

1.2 Discuss the differences between a personal license and a premises license
Personal license and premises licences are two different section but in both of the cases it
is necessary to obtain the license. While talking about premises license, it is said that this types
of license is granted to operate and work in any of the specific field for example, alcoholic
beverage shop, pub & late night clubs and many more. When it comes to personal license, it can
be explained as requirement of permission to sale and supply of any of the alcoholic product
within the specific area and even personal license is always granted for maximum up to 10 years.
The fees which is charged is premises license is higher compared to personal license
(Gunningham, Kagan and Thornton, 2014).
1.3 Compare the procedures for licences application.
It can be understood that the person requires the personal license whenever they need
they are self employed or either they are operating any of the small level of business where
obtaining license is must. Some of basic requirement which is needed to be followed to obtain
personal license is explained below:

be used by the staff are listed below:

training to each and every employee's or staff (Carver and et. al., 2013).

unnecessary drugs.

Imperial Guest is one of the renounce hotel within UK which delivers various kind of
offers and services to its customers. It has been delivering the of the needs which is required by
the customers. They also provide cafeteria service in which alcoholic drinks are also available as
per the needs and demand of customer. The current address of the hotel is 28 Bulstrode Rd,
Hounslow TW3 3AP, UK.
The license of Hotel had taken by Imperial guest house were they delivers various
services and they are not allowed to charge higher amount of money for any of the services
which they gives. Each and every information are mention in the price list for example: room of
the price, cost of any food and beverages and alcohol prices. If in case, hotel charges wrong price
for any of the product then they will be held personally liable under Unfair Trading Regulation,
2008 (Landes and Posner, 2014). In addition they tries to breach any of the terms and condition
by misleading then they will be fall under the category of breaches of CPRs and then they can be
sued under legal proceedings. Some of the area which is covered by Consumer Protection from
Unfair Trading Regulations 2008 are listed below:
 it clearly says that any of the customer should not be misguided as it is against the law. Regulations from 5 to 7 of CPRs clearly says that misleading activities are against the
law even if it is done by omission.
The concept of misleading occurs whenever
 any of the product are being sold at higher price.
 Insufficient information are not being provided by the trader.
 If false information are being share through the source of advertisement.

 If product and services do not match with the mentioned description.
2.2 Evaluate the extent of employer liability in the protection of consumers.
It is one of the major problem which is required to be solved and need to come over from
it. The most important thing in it is that the ultimate liability will always arise on employer as
they fails to meet the criteria and standard of care which they were needed to fulfil. The
liabilities of employer in the case they doesn't meet the criteria are listed below:
 Local Authority Trading Standards Services, Office of fair Trading and CPRs will take
the charge.
 Criminal prosecution will be bought in by the above mentioned panel.
 Proof is required in which it is needed that employer knowingly breached the terms and
condition.
 Although, it is proved that consumer misguided the consumer but still they cannot claim
for compensation (Easterbrook, 2013).
 There are other various charges can be imposed on the company in which their license
can be cancelled and even different penalties can also be imposed.
This are some of the area which is needed to be focused by employer because there
simple mistake can create lots of unnecessary problem for them which will have direct impact on
there long term sustainability within the market.

Law has been commenced in specified manner and even that helps to take any of the
decision so that working condition can become much and more easier. It is said that while selling
any of the product or service, it is necessary that standard formate must be considered else there
is huge possibility that various penalties can be imposed upon organisation. There are various
plans and policies which are being changed every year and among them some of them which has
been changed are explained below and the legislation have different concept on it. Amendments in the law of pre-packaged spirit drinks:It was one of those amendments
which says that any of the spirit products which are beyond the range of 100ml to 2000ml
must be reduced to different size range because it will not be allowed to sale any of those
similar product above 2000ml. This was one of the changes which has been done by
National Measurement Office, 2010.

 Change in Law of Food products: The health of any of the person plays the crucial role
whenever they visit in any of the place. It was one of the important decision which taken
and even it is very effective too because it started to show more better results. The new
law says that it is necessary any of the food products which are not in the stage of
consume then it must not be taken in use and if it found then legal action and various
penalties can be imposed (Hohfeld, 2016).
 Changes in Law for pre-packaged wines: There was slight change in the laws and
policies in which it is clearly mentioned that any of the bottle of wines should be above
the range of 1500ml. The range can be between 100ml to 1500ml. This law was also
introduced by the National Measurement Office, 2010.

The most important concept of any of the business organisation is that how any of the
work is required to be done and for they need to know about the rules and regulation about
license. As Imperial Guest House deals in hospitality sector, it is necessary for them deliver best
form of services to there customer. They are required to be aware of of the law which is related
to health and safety and food serving service.
 They are required to know in detail that food which they give to customer should be safe.
 Any of the side effect product should not be used while cooking the food (Scotchmer,
2015).
 Standard quantity should be maintained which is given in the terms and condition of law.
 Any sort of misguiding to the customer is not allowed. For example: the quality of food is
should match with labelling and advertisement.
 Traceability should be there whenever any of the authorised department or customer
wants them.
 The rating which is given the customer should be displayed in the board.
There are other various laws and regulation which is required to be followed by Imperial
Guest House such as food and safety law, noise and electricity at work, reporting of any of the
injury. In addition, hotel is required to followed some of the additional law too so that they can
perform well within the market.

 General Food Law Regulation: It is the law and regulation which says that hotel and
food industry must follow the legislation which is connected with safety and food,
traceability and withdrawal or recall of unhygienic food products.
◦ In article 14, it has been clearly mentioned that unhealthy and unsafe food should not
be sold (Besen and Raskind, 2014).
◦ In article 16, talks about the food labelling where it should not differ from
advertisement.
◦ When it comes to Article 18, it says that there should be traceability it is clearly
understood that traceability should be there related to the information of food
products there where it was manufactured.
 Health and Safety at workplace Act, 1974: It is one of the law which is required to be
considered. The responsibility to handle this law is in the hands of employers and it is
there responsibility to make sure that working condition which is being provided to
employee's should be safe and comfortable. The main aim of this act is to reduce the
number of unwanted accident in workplace (Marmor, 2012). In this law, it I has been
clearly mentioned that proper training should be given to each and every employee's so
that unnecessary problem will not arise.
This are some of the laws and regulation that is needed to be complied by Imperial Guest
House, if they want to sustain within the market and increase there sell within the market.
3.2 Discuss the duties and responsibilities associated with the management of licensed premises.
Whenever business are incorporated it is necessary that various law and regulation need
to be considered so that effective results can be obtained. It is said that main motive of obtaining
license is to make sure that what are those laws and regulation which helps to bring best out of
the organisation without any of the default. When it comes to hospitality industry, it is necessary
for them consider some of the rules and regulation which are explained below:
 They are required to ensure that they will be able to deliver the services of fast foods to
customer whenever they requires.
 It is necessary that facility of drop service should be provided to the customer whenever
they consume hard drinks to reduce the number of unwanted accident.

 It is necessary in hospitality field that various types of drinks should be available in
which it is necessary that it should be of different range price so that customer can feel
easy and comfortable with flexibility (Inkster, 2013).
 If hotel have not obtained the special license, they are not allowed to deliver any of the
service expect the business hour and if it is found then it will fall under the category of
serious offence.
 They are required to take special license under which they can deliver the service for 24
hour which will help them to conduct any of personal or private functions.
 The license clearly prohibits that any of those activities should not be conducted which
can create unnecessary problem such as liquor products should not be given to the
children who are minor. Use or consumption of any drugs by any of the customer will
directly affect on the license of hotel industry.
 The main responsibilities after getting license is that any of those products should not be
supplied due to which health of customer can be affected directly or indirectly.

License is required by each and every organisation as it decides that what are those safety
department which is needed to be incorporated to run a successful organisation so that better
results can be obtained (Samuelson and et. al., 2014). Below various department are required to

UK to deliver the safety and hygiene to every people.

 The cases related to food poison and other similar cases has been reduced significantly.

It is necessary for every single employer that they must provide proper healthcare to each
and every employee's who are working within there office premisses. As a employer, they have
huge role which is needed to be played so that organisation goals can be accomplished and for
that various roles and responsibilities is required to be played so that effective results can be
seen. There are various and regulation that is needed to be understand by employer and which is
explained below:
Employment law: It is said that employment law is one of the most crucial law for
having the healthy relationship between employer and employee's. This is the law which tells
that how work is needed to be done. It is one of those law which tells that how any of the worker
need to perform there duty and for how long they are required to work within the office or
factory premisses.
Health and safety law: This law ensures that employee's are getting proper healthcare
with in the office so that they can perform well. In this law, it has been clearly mentioned that
what are those safety equipment which is required to be given to employee's so that they can
perform their task easily (Johnson and et. al., 2018).
Employment Wages Act: It is one of the most important law which tells that how much
salary should be given to employee's whenever they perform their part of work. This law try to
ensure that each and every employee's should be treated equally in terms of wages if they are
working on the same ground.

 Leave should be given at least once a week.
 Annual paid holidays are required to be given to every employee's.
This are some of the role and responsibilities which has been allocated to the employer
which they must fulfil towards the betterment of their employee's so that they can perform well
to achieve the target of an organisation.
4.2 Discuss the key aspects of discrimination legislation.
There are various laws and regulation which is protecting any of the employee's while
they are working within the organisation. In present scenario, it is the most important task for
any of the employee's that they must treat every employees. It is necessary that none of the
employee's should be discriminated on the basis of caste, culture, age, sex or even disability.
There are various laws which has been enforced to protect the rights of employee's.
Some of the law which is required to be followed by each and every organisation are explained
below:
Equality Act, 2010: This is the law in UK which has been enforced in year 2010 to
protect the rights of every employee's. Every employee's should be treated equally in workplace
and even in society. There are some of the other laws and regulation too before the enforcement
of equality act 2010 whose main motive was too remove discrimination on employee's on
workplace and society are Sex Discrimination Act 1975, Race Relation Act, 1976 and Disability
Discrimination Act 1995 etc (Aoki and Hu, 2014).

successfully. Premises license and an personal license do have huge difference. Special license is
required to be obtained by any of the business organisation to conduct any of those activity

equipment to their employee's while they working within the premises of factory or office.
